Terms and Conditions
- By its signature hereto, the Applicant consents to Trade Ocean Shipping Services (Pty) Ltd, hereinafter referred to as “The Company” performing a credit check with the relevant credit bureau and obtaining full information from all trade references supplied and any other relevant third party regarding Applicant’s credit worthiness.
- The Applicant undertakes to institute adequate administrative measures to ensure that the contents of all the documentation submitted to Trade Ocean Shipping Services (Pty) Ltd are duly verified and correct. The Applicant hereby indemnifies Trade Ocean Shipping Services (Pty) Ltd and holds it harmless against any claim whatsoever which may arise against Trade Ocean Shipping Services (Pty) Ltd from any act of negligence, omission, or default on the part of the Applicant acting in the course of this agreement, unless the cause for such claims can be attributed to any circumstances within Trade Ocean Shipping Services (Pty) Ltd.’s reasonable control. The Applicant will pay any fines levied in such case by the Customs and Excise office.
- Any reconciliation’s or queries from the applicant have to reach Trade Ocean Shipping Services (Pty) Ltd within two calendar weeks from delivery of invoice.
- If any outstanding amount are not settled within terms granted by Trade Ocean Shipping Services (Pty) Ltd, Trade Ocean Shipping Services (Pty) Ltd has the right to: (a.) Charge interest per month on the overdue amount at 2% per month or the maximum rate as prescribed in terms of the National Credit Act from time to time whichever is the highest (b.) Refuse to supply any further services to the Applicant, (c.) Cancel the credit facilities and demand full settlement of all outstanding amounts with immediate effect.
- The Applicant will be held responsible for any fees incurred by Trade Ocean Shipping Services (Pty) Ltd to collect any arrears, as determined by the Court of Law or tribunal where the collection matter will be adjudicated.
Declaration:
- We understand that this agreement is binding once accepted and signed by both duly authorized representatives from the Applicant and Trade Ocean Shipping Services.
- Both parties choose their domicile citandi et executandi as the addresses stated in this agreement.
- We certify that the information contained herein is true and correct.
- We have read and understand the above terms and conditions and agree to it.
- By our signature hereto, we accept that all business undertaken by Trade Ocean is subject to their Clearing & Forwarding standard terms and conditions, as amended from time to time, a copy of which is available on request or can be viewed at tradeocean.co.za
